Mortgage Document (witness)

Each state has different requirements regarding witnesses for mortgage forms.

Who can witness my home loan Mortgage Document?

 

If the property is in NSW, VIC, WA, SA, TAS, or the ACT, the signing of home loan documents can be witnessed by:  
 

  • anyone over the age of 18 years old; and
  • not a party to the loan; and
  • has either known the person who is signing the documents for one year, or has taken reasonable steps to confirm the identity of the person signing the documents.

 
If the property is in QLD or the NT, the signing of home loan documents can be witnessed by:
 

  • A Notary Public
  • A Justice of the Peace (As of 30th September 2019, any Australian JP is acceptable)
  • A commissioner for declarations
  • A lawyer
  • A barrister
  • A solicitor
  • A legal practitioner
  • A conveyancer
